WHAT SHOULD EB-5 INVESTORS DO AMIDST TIGHTENING U.S. IMMIGRATION POLICIES?

Recently, the U.S. government has taken stricter actions regarding illegal immigration, leading many investors to question how the EB-5 program may be affected in the future.

According to lawyer Matthew Galati, this is not currently a concern: "Recent policies seem to focus on those who do not comply with the law. Currently, there haven't been many changes in the EB-5 program policies."

He affirmed that, as of now (September 2025), EB-5 is still considered one of the safest and most transparent U.S. immigration programs.

In addition to immigration policy issues, Matthew also shared insights on selecting safe EB-5 projects. According to him, investors should prioritize projects from experienced, reputable Regional Centers that have successfully processed EB-5 applications, especially those from Vietnam. This is the best way to minimize risks when preparing investment immigration applications.

Finally, to avoid delays or rejections in applications, investors need to be transparent in proving the source of funds. Instead of complex financial structures, keeping the application simple, clear, and compliant with pre-approved USCIS standards is more likely to yield positive results.

THE FUTURE OF EB-5 AFTER THE EXPIRATION OF THE RIA 2022 RULE?

According to lawyer Matthew Galati, what EB-5 investors need to pay attention to is not the 2026 milestone when the Reform and Integrity Act (RIA) expires, but the "grandfathering" principle stipulated in the law. Specifically, if investors submit their applications before September 30, 2026, they will be protected and continue to receive green cards, regardless of whether Congress extends the program or not.

He emphasizes "If I were an investor, I would consider September 30, 2026 as the real deadline." This is the "golden time" to act, because submitting the application before this milestone helps ensure rights, even if the processing time extends for months or years.

Regarding long-term strategy, the lawyer shares that EB-5 may continue to exist in some form after 2027. In the past, although the program was interrupted for 9 months, it then came back stronger. Therefore, EB-5 is still considered a reliable and safe path for those who wish to settle in the US.

While programs like the "Gold Card" have high costs and many uncertainties, EB-5 currently remains one of the safest and most effective options for immigrating to the United States.
